The state has opposed this extension, arguing that the defense has already been granted double the standard 14 days allowed by rule 24 and that the victims deserve finality. Furthermore, reports indicate that a juror from the case revealed she was contacted by the defense's private investigator and a lawyer who unsuccessfully attempted to have her admit to an error on one of the guilty counts.

While the defense remains optimistic about a future acquittal and intends to explore unexamined evidence—such as unknown male DNA found under Maggie Murdaugh’s fingernails—they have clarified that a retrial is unlikely to occur before the end of 2025.
