The Idaho Murders | The Case Against Bryan Kohberger

Bryan Kohberger's post-conviction case now includes a document the public did not have when he pleaded guilty. The newly unsealed filing says his former defense lawyers told Judge Steven Hippler that Kohberger was having trouble rationally processing adverse rulings and understanding how those rulings changed the risk of going to trial. 
His lawyers asked for additional time and expert assistance so they could communicate with him about major case decisions, including whether to testify or resolve the case with a plea. They expressly denied that Kohberger was legally incompetent. Hippler denied the additional time, and six days later Kohberger admitted guilt to four first-degree murders and burglary. 
Kohberger's new attorney Greg Rauch is now using that sequence as part of a broader effort to remove Hippler from the post-conviction case and challenge the plea. Rauch says the timeline does not automatically prove the plea was invalid. His argument is that it raises a factual issue about whether Kohberger had enough time and expert assistance to meaningfully participate in the decision. 
Kohberger's family has now entered that fight publicly. His parents and sisters say they support his effort to obtain post-conviction relief and want the full truth aired through a trial. Psychotherapist Shavaun Scott joins Tony Brueski to examine the family system around that decision, including what public support can mean when a convicted relative reverses course and claims his confession was false. 
Kohberger is serving four consecutive life sentences without parole plus ten years for burglary. The court will hear his request for a new judge and venue on October 15, 2026, and the post-conviction evidentiary hearing is scheduled for June 17, 2027. The sealed filing does not answer whether the plea survives. It gives the court one more record to test against what Kohberger swore to when he entered it.

Bryan Kohberger says his guilty plea was coerced while investigators warn that unredacted crime-scene photographs from the University of Idaho murders were allegedly passed to journalists and online creators. The plea challenge and the photo leak are separate legal problems, but both now center on access to information and what happened after that access was granted. 
A YouTube creator with more than 9,000 subscribers said she possessed unredacted images and told followers she was waiting to obtain more. On September 15, 2026, the Latah County Prosecutor's Office, Moscow Police and Idaho State Police said sensitive material had allegedly come from an unknown source and urged against further distribution. 
The state had already limited public release. Judge Megan Marshall ordered the City of Moscow to black out bodies and immediately surrounding blood. Idaho State Police then released nearly 2,800 crime-scene images in January 2026 and removed them the same day. 
The Goncalves family said the images were live by the end of a 12-minute warning call. Senate Bill 1250 later exempted death-investigation photographs from public disclosure. 
Kohberger's family entered the public fight on September 17 and said it supports his effort to withdraw the plea. His petition alleges ineffective counsel, false promises, threats tied to prison conditions and failures to disclose evidence he believes supports innocence. His plea transcript cuts directly across those allegations. Kohberger told Judge Steven Hippler that no one threatened him, no one promised anything beyond the agreement, no one told him to lie, and he was pleading guilty freely because he was guilty. 
The petition also points to hair from Ethan Chapin's right hand. Defense expert Ruth Ballard had examined one hair from that location before the plea and found it morphologically consistent with Chapin's own reference hair. The court will decide the plea challenge on evidence Kohberger can prove, while the alleged photo leak remains a separate question about how tightly controlled material reached the online true-crime ecosystem.

Bryan Kohberger's lawyers said in writing that they were not calling him incompetent, then told Judge Steven Hippler they needed expert help to communicate with him about whether to take a deal. Both statements come from the memo unsealed on September 22, 2026, in his post-conviction case.

Bryan Kohberger's family has entered the fight. In a statement exclusive to ABC News, the Kohbergers declared their full support for Bryan's bid to withdraw his guilty plea in the murders of Madison Mogen, Kaylee Goncalves, Xana Kernodle, and Ethan Chapin. They said they want "the complete and unvarnished truth" told through a proper trial.
Kohberger himself claimed in his petition that his former attorneys coerced him into confessing falsely. He's written that his parents and sisters were present for many of the discussions with his legal team before the plea. In his affidavit, he points to his family's involvement as proof that the pressure was real.

On September 17, the Kohberger family — parents Michael and Mary Ann, sisters Amanda and Mel — issued a formal statement through two retained attorneys to ABC News. They said Bryan's confession to the murders of four University of Idaho students was coerced by his own defense team. They want it thrown out. They want a trial.
Bryan Kohberger pleaded guilty on July 2, 2025, to four counts of first-degree murder and one count of burglary. He told the judge under oath that no one forced him. He confirmed he killed Madison Mogen, Kaylee Goncalves, Xana Kernodle, and Ethan Chapin. He signed a written factual basis admitting the killings were willful, deliberate, premeditated, and with malice. He waived his right to appeal.
His handwritten petition for post-conviction relief, filed from prison on July 27, 2026, names defense attorneys Anne Taylor, Elisa Massoth, and Bicka Barlow. He alleges they coerced his confession, withheld hair evidence, fabricated a story about death-row conditions, and told him it was legal to plead guilty to crimes he didn't commit. He wrote that his family was in the room during "most" of those discussions.
The hair he calls hidden was examined by his own defense expert, Ruth Ballard. She found it morphologically consistent with victim Ethan Chapin's own hair. That analysis was filed with the court by Taylor on June 6, 2025 — one month before Kohberger signed the deal. "Clumps of hair," his description of the evidence, appears in no court or police record. It appears in a bestselling book.
His family's civil attorney framed the plea as a "business decision" driven by fear. Prosecutors call the entire effort a "fishing expedition." Kohberger's team has filed a motion to disqualify Judge Hippler, citing his sentencing comments. A hearing on that motion is set for October 15. An evidentiary hearing — if it survives — is scheduled for June 17, 2027.
